1. Acceptance of Terms
By accessing or using The Gun Market (thegunmarket.com.au), you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance.
2. Platform Purpose
The Gun Market is a classifieds and enquiry platform only. We do not facilitate, process, or guarantee any transaction between buyers and sellers. We do not hold, transfer, or take custody of any firearms or related items. All sales and transfers are the sole responsibility of the parties involved.
3. Legal Compliance
All users must comply with applicable Australian federal, state, and territory laws governing the sale, purchase, transfer, and possession of firearms and related items. It is your responsibility to ensure any listing or transaction you participate in is lawful in your jurisdiction. The Gun Market does not provide legal advice.
4. Eligibility
You must be at least 18 years of age and hold any required licences or permits to use this platform for the purpose of listing or enquiring about firearms. By creating an account, you represent that you meet these requirements.
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts at our discretion.
6. Listings
All listings must be accurate, lawful, and comply with our listing guidelines. Listings are subject to review and approval before becoming publicly visible. We reserve the right to remove any listing at any time without notice. Sellers must hold the appropriate licences for items listed. The Gun Market takes no responsibility for the accuracy of any listing.
7. Prohibited Content
You must not list items that are prohibited under Australian law, including but not limited to: automatic weapons, silencers (without appropriate licence), prohibited handguns, or any item that would constitute an offence to possess, sell, or transfer. Any listing found to be in breach will be removed and the user may be suspended or reported to relevant authorities.
8. Firearm Transfers
All firearm transfers arranged through The Gun Market must be completed via a licensed firearms dealer in accordance with applicable state and territory law. The Gun Market expressly prohibits the use of this platform to arrange any unlicensed or illegal transfer of firearms.
9. Limitation of Liability
To the maximum extent permitted by law, The Gun Market and its operators are not liable for any loss, damage, injury, or harm arising from the use of this platform, including but not limited to: transactions between users, inaccurate listings, reliance on information posted by users, or failure of the platform. Our total liability is limited to the amount paid by you (if any) in the 12 months preceding the claim.
10. Intellectual Property
All content, branding, design, and code on The Gun Market is the property of its operators unless otherwise stated. You may not reproduce, distribute, or create derivative works without our express written permission. By submitting content (listings, images, messages), you grant us a non-exclusive licence to display and use that content on the platform.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the platform, you consent to the practices described therein.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
